Memo to: College Sports Council (CSC)    From: Eric  Pearson, Chairman CSC  www.collegesportscouncil.org    Re: July 11 Letter issued by OCR    Dear Coaches, Parents, Alumni, and all college sports fans;    Last Friday, July 11 assistant Secretary Reynolds issued a letter stating that the three-part test will remain intact as the OCR's method to test compliance with Title IX. This clearly is a "cave-in" by the Bush Administration to the gender quota advocates. I urge all of you to e-mail President Bush immediately to inform him of your displeasure with this recent action. Even if you write just one sentence please send something. Email addresses are listed below for your convenience.    I suggest that you make the following points:  1. You support Title IX as it was originally written.  2. Proportionality has created a quota system in college sports.  3. The three part test doesn't work because schools rely only on proportionality.  4. We will continue to see the unnecessary elimination of opportunities for men to participate in college sports.       Despite last weeks bad news we remain optimistic because our existing strategy already contemplated the Administration's action.  Indeed, from a purely legal perspective, we welcome it because it provides the formal denial of our recently filed petition to repeal the three part test. (See attached file to read the full petition document.) even Judge Sullivan recognized that such a denial provides legal standing to sue the Department of Education.    Rest assured, we will continue to press the Administration for more fair and reasonable regulations through every means available to us.
