Coaches Move for Summary Judgement in Title IX Lawsuit

June 17, 2002  (Washington, D.C.) -- In their strongest legal move to date, attorneys for the College Sports Council today filed for summary judgement in their suit against the Department of Education, asserting that they have proven the current interpretation of Title IX amounts to a destructive quota system.     The College Sports Council, a group comprised of men and women coaches from a variety of sports, is asking that a federal court vacate the so-called "three-part test" in Title IX, saying that it "has become a license to discriminate based on gender."    "It is time to restore basic fairness to Title IX," said Mike Moyer, Executive Director of the National Wrestling Coaches Association.  "Nowhere else in American life would we tolerate discrimination or quotas and our best and brightest student-athletes deserve better."    The suit, filed in January, alleges that in 1996 the Department of Education unlawfully altered the way it interprets Title IX.  That improper rulemaking and its enforcement have led to the arbitrary elimination of hundreds of athletic programs at schools across the country, costing student-athletes both scholarships and their dreams of competition.
